OFFICIAL RULES + REGULATIONS

The following are the Official Rules and Regulations (the "Rules") of the Concord Pacific Group Community Photo Competition (the "Competition").

1. Applicable Laws

This Competition is void where prohibited by law and is subject to all federal, provincial and municipal laws and regulations. The Concord Pacific Group (the "Sponsor") reserves the right to make changes to, cancel or extend the Competition, at any time in its sole discretion. All issues and questions concerning the construction, validity, interpretation and enforceability of the Rules or the rights and obligations as between a participant in the Competition (the "Participant") and the Sponsor in connection with the Competition shall be governed by and construed in accordance with the laws of the province of British Columbia and federal laws of Canada including procedural provisions without giving effect to any choice of law or conflict of law rules or provisions that would cause the application of any other jurisdiction's laws.

Subject to the applicable laws, these Rules govern all aspects of the Competition and are binding upon all Participants. In the event of any discrepancy between the Rules and the conditions and explanations appearing on any other documents, these Rules shall take precedence.

2. Eligibility

To be eligible for this Competition, an individual must be:

a. a legal resident of British Columbia and 19 years of age or older as of June 20th 2008; and

b. the sole owner of all right, title and interest (the author and the owner of the copyright) in and to the photograph, the narrative, the title and all other material submitted in connection with the Competition (collectively, the "Photograph"). Employees of the Sponsor, its respective affiliates, subsidiaries, related companies, advertising and promotional agencies, judges of the Competition and the household members and/or the immediate family of any of the above, are NOT eligible to participate in the Competition. For the purpose of these Rules, "immediate family" means husband, wife, spouse, mother, father, brother, sister, son and/or daughter, whether or not they reside in the same household. The Sponsor shall have the right at any time to require proof of identity and/or eligibility to participate in the Competition. Failure to provide such proof may result in disqualification. All personal and other information requested by and supplied to the Sponsor for the purpose of this Competition must be truthful, complete, accurate and in no way misleading. The Sponsor reserves the right, in its sole discretion, to disqualify any Participant in the event a Participant supplies untruthful, incomplete, inaccurate or misleading personal details and/or information.

3. Competition Period

The Competition will begin at 9:00 a.m. Pacific Standard Time ("PST") on Friday, June 20th, 2008 and will close at 12:00 p.m. PST on Saturday, September 20th, 2008 (the "Competition Period").

4. Judging and Selection

Criteria: The judging criteria will be based on how well the creative concept, technical merit, execution and overall presentation of the Photograph best reflects the theme of the Competition. The theme of the Competition is to reflect the past 20 years of evolution in Concord Pacific Place or project how the community will further develop in the future. Photographs of people, places, architecture, scenery, streetscapes, skylines, activities, memorable moments, etc. at Concord Pacific Place can be used to express and show this evolution and development.

Judging: The Photographs submitted will be judged in two rounds as follows:In the initial round of judging, a panel comprised of Sponsor personnel will select up to 12 top entries (the "Top Entries"). The Sponsor will attempt to contact the Participants of the Top Entries (the "Top Participants") by telephone and/or email. If a Top Participant cannot be contacted by the Sponsor within five business days, the Sponsor shall have the right to select another Participant in his or her place.  The Sponsor shall be fully and completely released and discharged from any liability or responsibility in this regard.

In the final round of judging, a panel comprised of Sponsor personnel and invited guests will select the 1st, 2nd and 3rd prize winners in each category from the Top Entries. The Top Entries not awarded one of the top three prizes in the category entered will receive honorable mention awards. Each selected Photograph will be enlarged to a size determined by the Sponsor and printed on glossy photo paper by the Sponsor, no exceptions.  The Sponsor assumes no responsibility for any error, omission, interruption, deletion defect, destruction or tampering to or unauthorized alteration of the entries. 

Award Presentation: The Top Participants will be notified and invited to attend a special reception at the Concord Pacific Presentation Centre at 88 Pacific Boulevard this Fall when the three top prize winners in each category will be announced and the prizes awarded. The Top Participants must either attend in person or appoint a designated person to attend the reception on their behalf in order to be considered in the final round of judging and to receive a prize.

The winners will be selected in the sole opinion and discretion of the judging panels and will not reflect the opinion of the Sponsor. Judges’ decisions will be final and all prizes must be accepted as awarded.

6 $200 Honourable Mention Provence Marinaside Gift Certificates will also be awarded.

6. How to Enter

No purchase is necessary to enter the Competition. Entries will only be accepted using the online method described below. All entries must be submitted within the Competition Period. To enter,complete and submit the entry form.  Each participant must submit his/her entry form, along with a single digital photograph and a brief narrative.

The photograph must adhere to the following requirements:

  • JPEG format
  • Width and depth be no less than 2500 pixels per square inch
  • Maximum file size 9 MB
  • The narrative must not exceed 35 words.

Each Participant is limited to one entry per category. Greater than one entry per category submitted by the same Participant shall result in disqualification of all entries by that Participant.

Entry must be received no later than the end of the Competition Period. Entry will be declared invalid if they are late, incomplete, damaged, irregular, mutilated, forged, garbled or mechanically or electronically reproduced. With the exception of the Top Participants, no communication will be exchanged between the Participants and the Sponsor.

7. Photo Release Form

Where the Photograph includes an individual, the Participant will obtain a copy of the Photo Authorization and Release Form (the "Photo Release Form") signed by such individual or individuals and the Photo Release Form will be delivered to the Sponsor upon request.  A PDF of the Photo Release Form can be obtained online. 8. Use of Photographs and Name

All rights, copyrights and interests pertaining to Photographs submitted shall remain the property of the Participant. In this regard, the Participant acknowledges and agrees that:

a. the Sponsor may, once submitted and in its sole discretion, exhibit, produce, reproduce, publish and/or distribute any Photograph with or without modifications made by the Sponsor, in any medium (including without limitation marketing material) and at any time, for any purpose (excluding sale), all without compensation or notice to the Participant or any future holders of the rights, copyrights and/or interests in perpetuity;

b. the Sponsor may, in its sole discretion, use the Participant’s name through any medium in connection with such exhibition, production, reproduction, publishing and/or distribution in perpetuity; and

c. the Participant will not at any time offer or agree to sell the rights, copyrights and/or interest of the Photographs submitted to a Third Party unless the Participant has received a bona fide written offer or agreement to sell the rights, copyrights and/or interests in the submitted Photograph which is from a Third Party and the Participant has provided written notice to the Sponsor enclosing the offer stating that the Participant is willing to accept such offer.  The giving of the notice shall be an offer by the Participant to sell the rights, copyrights and interests to the Sponsor at the price (including all applicable taxes), which offer shall remain open for acceptance by the Sponsor for a period of 7 business days following the date upon which the notice is received by the Sponsor and may not be withdrawn by the Participant during such period.  The acceptance by the Sponsor of the Participant’s offer shall constitute a binding agreement of sale in respect of the rights, copyrights and interests of the submitted Photograph.  If the Sponsor does not accept the Participant’s offer within such 7 business day period, the Participant shall be free to sell the rights, copyrights and interests of the submitted Photograph to the third party (pursuant to Rule 8) who made the offer pursuant to and at the price and terms specified therein but not otherwise; provided that if such sale has not been completed within 30 business days after the date upon which the notice was received by the Sponsor then any subsequent sales may be made, and the right of first refusal contained herein shall survive and continue in full force and effect.

9. Confirmation by Participant

By participating in the Competition the Participant confirms, acknowledges and agrees that he/she:

a. is eligible for the Competition;

b. will comply with and abide by the Rules; and

c. will accept any award as offered.

10. Release

By entering the Competition, the Participant releases and indemnifies the judges and the Sponsor, including its subsidiaries, affiliates, employees, directors, officers, suppliers, agents, sponsors and administrators (collectively, the "Releasees") from any and all liability for any loss, harm, damages, cost or expense arising out of participation in this Competition, participation in any Competition related activity or the acceptance, use, or misuse of the awards, including but not limited to costs, injuries, losses related to personal injuries, death, damage to, loss or destruction of property, rights of publicity or privacy, defamation, or portrayal in a false light, or from any and all claims of third parties arising wherefrom..

11. Warranties and Representations

By entering the Competition, the Participant warrants and represents to the Sponsor that:

a. the Photograph is an original work, solely created by the Participant, and that no third party participated as a photographer, co-author or otherwise in the creation of the Photograph or any part thereof;

b. the Photograph does not infringe any copyright interest, intellectual property or other statutory or common law rights of any third party;

c. the Photograph does not contain any material that is defamatory, libelous, profane or obscene and does not violate any laws relating to hate speech or otherwise;

d. the Sponsor reserves the right to exclude any Photograph on the basis of concerns relating to the rights of third parties, including but not limited to privacy, copyright, defamation, rights of personality, obscenity, hate speech, as determined by the Sponsor in its sole discretion; and

e. the Sponsor assumes no responsibility for any claims of infringement of rights to privacy and/or personality, and all such liability shall remain with the Participant and the Participant hereby fully indemnifies the Sponsor for any and all claims in this regard.

12. Indemnification by Participant

By entering the Competition, the Participant releases and holds all Releasees harmless from any and all liability for any injuries, loss or damage of any kind to the Participant, Releasees or any other person, including personal injury, death, or property damage, resulting in whole or in part, directly or indirectly, from acceptance, possession, reproduction, use or misuse of any prize, participation in this Competition, any breach of these Rules, or in any prize-related activity. The Participant agrees to fully indemnify the Releasees from any and all claims by third parties relating to the Competition, without limitation.

13. Limitation of Liability

The Sponsor assumes no responsibility or liability for lost, late, misdirected or incomplete entries, notifications, responses, replies or any Release, or for any computer, online, telephone, hardware, post office or delivery errors, software or technical malfunctions that may occur, including but not limited to malfunctions that may affect the transmission or non-transmission of an entry.  The Sponsor is not responsible for and assumes no responsibility in connection with:

a. any incorrect or inaccurate information, whether caused by website users or by any of the equipment or programming associated with or utilized in the Competition or by any technical or human error which may occur in the administration of the Competition;

b. any error, omission, interruption, deletion, defect, delay in operation or transmission, communications line failure, theft or destruction or unauthorized access to, or alteration of, entries;

c. any problems, failures or technical malfunction of any telephone network or lines, computer online systems, servers, providers, computer equipment, software, e-mail, players, or browsers, on account of technical problems or traffic congestion on the internet, at any website, or on account of any combination of the foregoing;

d. any injury to the Participant or damage to any computer related to or resulting from participating in or downloading materials in connection with this Competition; or

e. loss or damage in the event the Competition cannot be conducted as planned for any reason, including those reasons beyond the control of the Sponsor, such as infection by computer virus, bugs, tampering, unauthorized intervention, fraud, technical failures, or corruption of the administration, security, fairness, integrity or proper conduct of this Competition and/or the Competition website (www.Celebrate20Years.com, the "Competition Website").

The Participant assumes liability for injuries caused or claimed to be caused by participating in the Competition, or by the acceptance, possession, use of, or failure to receive any prize.

14. Conduct

By entering the Competition, each Participant agrees to be bound by the Rules, which will be posted at the Competition Website. The Participant further agrees to be bound by the decisions of the Sponsor, which shall be final and binding in all respects. The Sponsor reserves the right, in its sole discretion, to disqualify any Participant found to be:

a. violating the Rules;

b. tampering or attempting to tamper with the entry process or the operation of the competition, and/or the Competition Website;

c. violating the terms of service, conditions or use and/or general rules or guidelines; and/or

d. acting in an unsportsmanlike or disruptive manner, or with intent to annoy, abuse, threaten or harass any other person.

CAUTION: ANY ATTEMPT TO DELIBERATELY DAMAGE THE COMPETITION WEBSITE, OR UNDERMINE THE LEGITIMATE OPERATION OF THE COMPETITION MAY BE A VIOLATION OF CRIMINAL AND CIVIL LAWS. SHOULD SUCH AN ATTEMPT BE MADE, THE SPONSOR RESERVES THE RIGHT TO SEEK REMEDIES AND DAMAGES TO THE FULLEST EXTENT PERMITTED BY LAW, INCLUDING BUT NOT LIMITED TO CRIMINAL PROSECUTION.

Participants must not at any stage of the Competition discuss with or take advice from any or all of the judges on any matters relating to their participation in the Competition.

15. Privacy/Use of Personal Information

By entering the Competition, the Participant:

a. grants to the Sponsor the right to use his/her name, mailing address, telephone number, and e-mail address ("Personal Information") for the purpose of administering the Competition, including but not limited to contacting and announcing the Top Participants;

b. grants to the Sponsor the right to use his/her Personal Information for publicity and promotional purposes relating to the Competition, in any and all media now known or hereafter devised, without further compensation unless required by law; and

c. acknowledges that the Sponsor may disclose his/her Personal Information to third-party agents and service providers of the Sponsor in connection with any of the activities listed in (a) and (b) above. The Sponsor will use the participants Personal Information only for the purposes identified above.

For greater certainty, the provisions of this Rule 15 are in addition to the provisions of Rule 8.

16. Intellectual Property

All intellectual property, including but not limited to trade-marks, trade names, logos, designs, promotional materials, web pages, source code, drawings, illustrations, slogans and representations in connection with this Competition are owned by the Sponsor and/or its affiliates. All rights are reserved. Unauthorized copying or use of any copyrighted material or intellectual property without the express written consent of its owner is strictly prohibited.

17. Changes and Termination of the Competition

Subject to the applicable laws and regulations, the Sponsor reserves the right, in its sole discretion, to terminate the Competition, in whole or in part, and/or modify, amend or suspend the Competition, and/or the Rules in any way, at any time without notice or compensation.
